Closing Arguments In Trial Delayed, Evidence Found

CENTENNIAL, Colo. (CBS4) ―

Lawyers are expected to make their closing arguments Friday in the trial of a man accused of killing two people, including a witness who was scheduled to testify against him. The delay came after new evidence was discovered.

Sir Mario Owens could face the death penalty if convicted of first-degree murder in the June 2005 shooting deaths of Javad Marshall-Fields and Vivian Wolfe.

Each side will have 2 1/2 hours to make final arguments before jury deliberations begin. The judge wants the arguments to happen all in one day. They'll start Friday morning at 8:30 a.m.

Closings had been expected to start Thursday but the judge pushed them back because of the amount of time required and the new evidence.

A car initially taken into custody by police for a different crime was somehow lost until earlier this week. Investigators found it sitting in their impound lot. Owens was allegedly in that car during a different crime, so the defense says there wasn't adequate time to prove or disprove whether it was related to the Marshall-Fields murder.

The defense argued Thursday morning that it didn't have enough time to process the evidence and asked for mistrial. The judge denied that request.

Marshall-Fields was to testify against Owens and another man in a separate shooting death. Owens was eventually convicted of murder and sentenced to life in prison in that case.

Wolfe was Marshall-Fields' fiancee.
