Wood-burning fire pits are illegal in Denver.
CBS
CBS4 found retailers in Denver selling outdoor wood-burning fire pits to customers without knowing that using them in the city is illegal. The lack of a warning has set some consumers back hundreds of dollars.
"The bottom line is they're unlawful in Denver," said Lt. Phil Champagne of the Denver Fire Department.
The fire pits can cost as much as $2,500.
CBS4 went to three retailers and inquired about the outdoor fire pits' legality in Denver. Salesmen at all three said the pits were okay.
CBS4 then went back to tell the retailers of the 12-year-old law. Selling the fire pits in Denver is legal, but their use in Denver backyards is illegal because of the wood burning aspect.
Fire pits that use propane or natural gas are legal and allowed.
Home Depot told CBS4 that it is pulling the fire pits off the floor in its Denver stores while the issue is reviewed and researched. The store said it may stop selling them permanently.
The other two retailers CBS4 visited said they will inform Denver customers of the law about fire pits.
Violating the rule means a first offense warning. Repeat offenders could be fined up to $999 or face 6 months in jail.
