Murder Suspect: 'Beating Went Too Far'

FORT COLLINS, Colo. (CBS4) ― A man accused of killing the man who served his divorce papers told investigators he knew he'd gone too far when he hit the victim with a bat, but he continued the deadly beating anyway.

Stephen Allen died in May. The process server had been beaten and stabbed. The accused killer, James Whitler, was in court Friday for a preliminary hearing.

Investigators say Whitler hit the victim at least 15 times and was strangling his own children when police arrived.

The killing happened in Loveland just after the victim served divorce papers with Whitler's wife.

Police say they found the suspect on top of his two children, a boy and a girl, with his arm tight around the girl's neck. The girl had also been stabbed twice.

Both children survived.

Whitler is charged with murder and attempted murder.
