Chief U.S. District Judge Edward Nottingham will not be at the courthouse this week for the second consecutive week, a court official said Monday morning.
Although some news outlets reported on Thursday that Nottingham was expected to resign, perhaps as early as last Friday, "there is no resignation," the official, Brenda Martinez, said.
The judge for about a year has been under investigation for alleged misconduct and early last week he was notified of a new official misconduct complaint against him. A Denver television station reported Thursday that the complaint, filed by a prostitute, alleges the judge asked her to lie to investigators about months of ongoing sexual relations between him and her.
Nottingham worked at the courthouse on Tuesday of last week, but called in sick on Wednesday, Thursday and Friday.
Martinez, the court administrator's administrative assistant, said Nottingham on Monday morning notified the court's administrator, Clerk of the Court Greg Langham, that the judge would not be at the courthouse again this week. It was not known immediately if the judge gave a reason for his absence, but it did not appear to be illness, Martinez said.
The judge and an attorney representing him in the investigation have maintained silence about the investigation and the judge's intentions.
