A judge has denied a request to dismiss a lawsuit against the Catholic Diocese of Pueblo filed by a man who alleges a priest sexually abused him.

The diocese argued the man waited too long to sue.

Pueblo County District Judge Victor Reyes ruled Monday the suit was filed within the two-year time window. Reyes says the window didn't begin until the man first suspected the diocese was negligent and that there were other victims.

Church officials didn't return a call seeking comment.

The suit, filed by a Colorado prison inmate identified as John Doe No. 7, alleges church officials knew the priest was a threat to children but didn't act.

The priest identified in the suit, Andrew Burke, left the clergy in the 1970s and committed suicide in 2005.
