McCandless' Lawyer: She Didn't Make Call

Former Brighton Charter Teacher Expected To Post Bond

FORT COLLINS, Colo. (CBS4) ― The former Brighton Charter High School teacher accused of having sex with a 17-year-old student was expected to post bond on Monday after appearing in court on charges she called the alleged victim, in violation of her previous bond.

A judge set her new bond at $25,000 on Monday. She previously posted a bond of $20,000 in the first case.

McCandless allegedly called the student on his cell phone following a court hearing on Jan. 22.

McCandless' attorney believes the call to the alleged victim was a prank since the caller ID showed it came from the 415 area code of San Francisco. He added that there is so much interest in the case online that he's convinced the call was a hoax.

"My biggest concern is that (the call) was made from an individual who is not a party to the case," said Trent Trani, McCandless' attorney. "My position is that the district attorney has not established, even by a preponderance of the evidence, that Ms. McCandless made this telephone call."

Trani said he wasn't accusing the alleged victim of lying about receiving the call, but said the call could have come from someone else.

Prosecutors said the alleged victim was certain it was McCandless on the phone and that he recognized her voice.

She also faces one count of sexual assault on a child by a person in a position of trust and one count of contributing to the delinquency of a minor stemming from incidents alleged to have occurred during a school-sponsored trip to the YMCA of the Rockies in Estes Park last October.

McCandless is scheduled to appear for a preliminary hearing on the sex assault charge Feb. 22. She due in court for a hearing on the charge of violating her bond on March 1.
