The trial of a man in Denver charged with attempted murder was supposed to start Monday before the alleged victim and primary witness was killed at her home in Cherry Creek last week.
Brian Hicks, 27, was back in court Monday as prosecutors tried to keep him behind bars.
Hicks was accused of shooting at
Kalloniann Clark-James. Clark was killed last Wednesday night.
Prosecutors asked a judge to increase Hicks bond to $2 million on Monday. It was increased from $200,000 to $500,000. The judge said $2 million would be oppressive.
Hicks was in the custody of authorities when Clark-James was shot. He was actually being held on charges of possessing 8.8 lbs. of cocaine.
A friend of Hicks, who would not identify herself outside the courtroom, defended him.
"He's been good to me as long as I've known him," she said. "As long as I've known him he's done so much for my daughter, he done so much for me."
Hicks' wife,
Tamaya James, was arrested last week when he was in court. She was charged with threatening Clark James, the woman who was killed last week.
"I'm telling you that (Hicks) was incarcerated at the time of this situation," said Harvey Steinberg, Hicks' attorney. "And that's the ultimate alibi."
Steinberg added that he would like a tape of James' alleged threat toward Clark-James released by police and played in court. The judge denied that request.
Prosecutors didn't say in court they believed Hicks was involved in Clark-James' murder, but did point out some big coincidences.
Police have offered a $10,000 reward for information leading to information about Clark-James' death.
