Appeals Court Again Denies Release Of CU Report
DENVER (AP) ―
The Colorado Court of Appeals refused Thursday to order the release of a grand jury's report on it investigation into a football recruiting scandal at the University of Colorado.
A Denver District Court judge refused in September 2004 to unseal the report, because the investigation led to the indictment of a former football recruiting aide.
An appeals court panel said that judge made the correct decision under grand jury secrecy rules, which allow the release of an investigative report only if no indictments are made.
Former Attorney General Ken Salazar had asked District Judge Jeffrey Bayless to release the report and appealed the judge's refusal.
Attorney General John Suthers continued the appeal after he was appointed to replace Salazar, following his election to the U.S. Senate.
The grand jury conducted one of three investigations into allegations that the CU football program used drugs, sex and alcohol to entice blue chip recruits and that nine women since 1997 had been assaulted by players or recruits.
Salazar headed a separate task force investigation and the CU Board of Regents appointed an independent panel.
