Nacchio's Attorneys Seek To Move Trial From Denver
DENVER (AP) ―
Former Qwest chief executive Joe Nacchio's attorneys have said he is "among the most reviled figures in recent Denver history" and that his trial on insider trading charges should be moved because he cannot get a fair trial in the city.
Nacchio is charged with 42 counts alleging he publicly exaggerated Qwest's financial health before selling about $101 million in company stock in 2001. He has pleaded innocent.
In documents filed Monday in U.S. District Court in Denver, Nacchio's lawyers asked for a change of venue if the judge refuses to drop the charges, as they have asked.
A spokesman for the U.S. attorney's office said prosecutors oppose moving the trial.
Also Monday, Nacchio's lawyers accused prosecutors of improperly influencing a grand jury before it handed up the indictments in December. Court filings accuse prosecutors of misleading grand by "pervasive misconduct."
U.S. attorney's spokesman Jeff Dorschner said the allegations were unfounded and that the government would respond in a court filing.
Nacchio's attorneys earlier argued for dismissing the charges on grounds the indictment was too vague.
