Broncos' Kircus To Stand Trial For Felony Assault

CENTENNIAL, Colo. (CBS4) ― A Denver Bronco has been ordered to stand trial after getting into a fight at house party back in May.

Wide receiver David Kircus was bound over to district court Thursday on a felony assault charge.

Still nursing a black eye from the alleged assault, Jeffrey Krieger, 24, testified he asked Kircus to leave his Centennial home after Kircus showed up around 3:30 a.m. to see a mutual friend named Leslie.

Krieger testified Kircus reacted by saying, "What are you, the tough guy around here?"

Krieger said he responded, "I don't want any trouble. I just want you to leave my house."

Krieger said when he led Kircus out through the garage, Kircus said, "Once we get to the end of the driveway, you're not protected anymore."

Krieger then testified he never saw the punch Kircus allegedly threw. He said it was, "… pop, flash, I just remember rolling on the ground."

"It was just so sad because Jeffrey was just doing the right thing trying to protect Leslie," Jeffrey's mother Mary Beth said. "He's really gone through a lot of pain and suffering."

Kircus' attorney Harvey Steinberg got Krieger to admit he had eight to 10 drinks before the confrontation and that Krieger had earlier helped give Kircus directions over the phone on how to get to his Centennial home. Steinberg also suggested Krieger put his hand on Kircus's arm, provoking the fight.

The fourth-year wide receiver is scheduled to be in court Aug. 21 to enter a plea.

Kircus passed a lie detector test later in May, said Broncos Head Coach Mike Shanahan, and was allowed to stay with the team. Kircus also said he acted in self defense.

Kircus is a backup receiver and return specialist who joined the team last season. He had nine catches for 143 yards.
